Conflict Minerals, REACH, EHS — Trend Review

At Assent Compliance we work with compliance departments around the word. How would one define the EHS industry? Is it cyclical? That would make sense since reporting periods have different intervals. Think of REACH with registration deadlines or Conflict Minerals with reporting deadlines. Or is compliance as an industry fairly consistent? That would also make sense, compliance doesn’t “go away”, yes new regulations might get passed but as an industry is there a big influx towards being more or less compliant?

The answer seems to be both. When a regulation is passed the trend spikes. See the conflict mineral search trends over the last several years or the REACH regulation which spiked in 2008. (first image EU REACH, second image Conflict Minerals)

So particular regulations spike as they are debated, passed and then deadlines emerge. As with REACH the regulatory landscape has normalized as compliance has become a regular part of doing business. Conflict minerals it appears is trending strong as companies both rush to comply and service providers enter the market. (Over 5 small, previously irrelevant firms have started touting they do conflict mineral compliance in the past 6 months. There are only actually 3 market leaders with Assent being ranked #1 or 2 depending on who you ask) . What about the EHS industry as a whole?

Consistent is the word

The Google trends analysis is about as regular and consistent as you can get. Compliance never goes away, but never really goes to crazy. What does this mean?

If you’re a company: Be prepared to be compliant and have a regular and scalable program in place. New regulations come up and compliance is a fact of business life.

If you’re a law maker: Be prepared that when passing the law, and when companies rush to comply there will be alot of buzz around your legislation. This is not a good thing or a bad thing, just a fact.

If you’re a consumer: Compliance is in your best interest. So feel some sense of security that the regulatory landscape is both expanding in terms of regulations and consistent in the way the industry is trending. Regulations are put in place to protect consumers or the population at large, so consistency is key
