ECHA Evaluating New Substances for SVHC Candidate & Authorisation Lists

The European Chemicals Agency (ECHA) recently opened two public consultations for substances being considered under the European Union (EU) Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) Regulation. Six substances have been proposed for addition to the SVHC Candidate List while 18 substances are being considered for the Authorisation List.

The consultations invite respondents to comment on the proposed substances. Feedback on the SVHC Candidate List is due by October 19, 2018, while responses to the proposed Authorisation List are due on December 5, 2018.

Substances being considered for the SVHC Candidate List include:

  • 2,2-bis(4′-hydroxyphenyl)-4-methylpentane
  • Benzo[k]fluoranthene
  • Fluoranthene
  • Phenanthrene
  • Pyrene
  • Undecafluorohexanoic acid and its ammonium salt

Updates to the SVHC Candidate List are expected to be made in December 2018 or January 2019, pending comments from the consultations. Once substances are added to the list, companies have a six-month window to communicate to downstream recipients if articles contain SVHCs over the 0.1% weight by weight (w/w) threshold.

If approved, proposed substances for the Authorisation List can only be used in the EU after their associated sunset dates (usually 36 months after a substance is added).

Substances proposed for the Authorisation List include:

  • 4,4′-isopropylidenediphenol (Bisphenol A; BPA)
  • 1,6,7,8,9,14,15,16,17,17,18,18-
    Dodecachloropentacyclo[,9.02,13.05,10]octadeca7,15-diene, (“Dechlorane Plus”™)
  • Reaction products of 1,3,4-thiadiazolidine-2,5-dithione, formaldehyde and 4-heptylphenol, branched and linear (RP-HP) with ≥0.1% w/w 4-heptylphenol, branched and linear (4-Hbl)
  • Fatty acids, C16-18, lead salts
  • Trilead dioxide phosphonate
  • Sulfurous acid, lead salt, dibasic
  • [Phthalato(2-)]dioxotrilead
  • Trilead bis(carbonate) dihydroxide
  • Tetraethyllead
  • 2-methoxyethanol
  • 2-ethoxyethanol

The ECHA has published the full list of substances proposed for the Authorisation List, along with examples of their uses.

Companies need to pre-emptively evaluate their use of these substances and ensure they provide their comments prior to the consultation deadlines. Comments, economic impacts and industry uses will be considered prior to final decisions on the proposed substances.
