European Commission Makes New Entry to REACH Restriction List

The European Commission has restricted another substance under Annex XVII of the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) Regulation. 

Entry 73, regarding the usage of (3,3,4,4,5,5,6,6,7,7,8,8,8-tridecafluorooctyl)silanetriol in aerosols, comes into effect on January 2, 2021. The entry also restricts the use of its mono-, di- or tri-O-(alkyl) derivatives.

Specifically, the update restricts the substance’s usage by the general public in mixtures containing organic solvents and in spray products, such as aerosols, spray pumps and trigger sprays.

The update restricts the usage of these substances to a concentration equal to or less than two parts per billion (0.0000002 percent ppb) for general public use. However, professional use is still permitted, with the caveat that products are labeled “For Professional Use Only” and “Fatal if Inhaled,” accompanied by the pictogram GHS06.

To keep access to European markets and avoid fines, companies that sell these types of products will need to evaluate the composition of their products for the existence of the restricted substance at a concentration of greater than two ppb. 

Companies that sell spray products to the general public need to understand whether these substances (or derivatives) are in their products, and reduce the amount to below two ppb before the stated deadline of January 2, 2021. Those that begin evaluating their supply chain now will be in a better position to ensure their products stay viable and on the market.
