New Updates REACH and RoHS II.

RoHS 2 / REACH update


It has been a busy time of year for EU legislators who recently passed the re-cast of the RoHS directive (more commonly known as RoHS 2) and agreed to add 8 SVHCs to the REACH SVHC candidate list. This was predicted by Assent Compliance through our Assent Compliance Management System Notifications and Environmental Webinars given earlier this year.

EU parliament approved the re-cast of the (RoHS) Directive. This new RoHS Directive will replace the old RoHS Directive (2002/95/EC) 20 days after it is published in the EU Journal. The Journal is expected to be published sometime in the next 3 months.
Here is an overview of some of the key items from the new RoHS Directive:
RoHS is now part of CE marking requirements
Mandatory recall requirements for non-compliant products has been added to the directive
Four (4) substances (all also covered under REACH) have been written into the directive and must be reviewed for inclusion into RoHS within the next three (3) years.
Exemptions will be reviewed every 4 years under the new RoHS directive


The Member State Committee has agreed with the ECHA on the addition of eight (8) substances to the REACH SVHC Candidate list. Here are the new substances:

1. Chromium trioxide
2. Acids generated from chromium trioxide and their oligomers
3. Cobalt(II)sulphate
4. Cobalt(II)dinitrate
5. Cobalt(II)carbonate
6. Cobalt(II)diacetate
7. 2-methoxyethanol
8. 2-ethoxyethanol

These substances should be officially adopted by January 2011 and will have immediate Article 33 communication requirements for Business to Business transactions in the EU.
