Proposition 65: What It Is and How To Comply

Proposition 65, or the Safe Drinking Water and Toxic Enforcement Act of the State of California, is a regulation with which many companies struggle to comply due to a lack of clear information. What is it, and what do companies need to do to demonstrate compliance?

Assent’s regulatory experts have published the whitepaper, Proposition 65: Understanding the Safe Drinking Water and Toxic Enforcement Act, to help companies confidently navigate the regulation.

What is Proposition 65?

Proposition 65 is designed to protect consumers from excessive exposure to chemical carcinogens and other toxins in their environment, drinking water and the products they purchase.

To achieve this, the State of California publishes and maintains a list of chemicals known to cause cancer, birth defects and/or reproductive harm to consumers. Today, the list includes some 100 chemicals found in pesticides, food, drugs, solvents and a range of common household products, along with many chemicals used or discharged by the manufacturing and construction industries.

What does Proposition 65 mean for companies?

Proposition 65 requires companies producing goods containing ‘listed’ chemicals in quantities above the safe harbor level to disclose this to consumers by providing ‘clear and reasonable warning’. It also prohibits companies from knowingly discharging listed chemicals into the state’s drinking water resources.

But how can companies be sure they are meeting the complex labeling requirements of Proposition 65? How can they ensure compliance with ‘safe harbor level’ considerations?

In the Proposition 65 whitepaper, our regulatory experts explain the regulation, its requirements and the associated enforcement guidelines to help readers understand how to approach compliance with confidence.

Topics discussed include:

  • What is Proposition 65?
  • How is the law enforced?
  • What are safe harbor levels?
  • The new ‘clear and reasonable warning’ requirements
  • …and more!
