RoHS Substance Addition – Phthalates join the Team

On December 17th, 2014 the EU Commission informed the World Trade Organization of the Draft Amendment for Annex II of RoHS.

For the first time, RoHS will have more than 6 restricted substances. Dibutyl phthalate (DBP), Benzyl butyl phthalate (BBP), Bis (2-ethyl(hexyl)phthalate) (DEHP) and Diisobutyl phthalate (DIBP) have been added to Annex II of the RoHS Directive (Directive 2011/65/EU).

The proposed date of adoption is February or March 2015 with the proposed entry into force being 20 days from publication in the Official Journal of the EU which will be approximately 3 months after adoption – approximately June of 2015. The Draft allows for transitional periods of application:

  • 22 July 2019 for all EEE except category 8 and 9 (medical devices and monitoring and control instruments)
  • 22 July 2021 for medical devices and monitoring and control instruments

Translation – As of July 22nd 2019, all EEE except medical devices and monitoring and control instruments will be, under RoHS, prohibited from containing more than 0.1 weight % each of the newly added phthalates per homogeneous material. This same restriction will apply to medical devices and monitoring and control instruments as of July 22nd 2021.

HBCDD had also been prioritised for evaluation for addition to RoHS but it was determined that it did not need to be added to RoHS since it is no longer used in Europe for EEE.

On Friday March 13th, it was released that the US had questioned a few items in the draft amendment from the EU Commission and it was clarified that a provision, which would clarify that the cables or spare parts for products placed on the market before the relevant compliance deadline are excluded from the new substance restriction, will be inserted into the final text.
