RoHS Update: China Releases Conformity Assessment Process

China has released the rules for a conformity assessment process required under the China Restriction of Hazardous Substances (RoHS) legislation. Companies that sell into the region will need to perform this assessment on any in-scope products by November 1, 2019.

The conformity assessment process only applies to products that fall under the 12 types of electrical and electronic categories published in the 2018 catalog.

The rules were published under the title “Implementation Measures for Conformity Assessment System for the Restricted Use of Hazardous Chemicals in Electrical and Electronic Products.” Published jointly by the State Administration for Market Regulation (SAMR) and the Ministry of Industry and Information Technology (MIIT), the new regulation introduces a voluntary certification and self-declaration system companies should adhere to in order to maintain market access in the region.

Products that pass the assessment process will receive one of two labels to affix to the product, in the same manner as the CE marking (though it does not replace it; the Environment Friendly Use Period [EFUP] and Green-e labels should also be applied to the product, if applicable). The new logos can be used on packages, product manuals and online marketing efforts. Companies that sell products in or into China have two options available to them to obtain the right to use the label:

  • Option 1: Voluntary certification through an official approval body (includes testing, factory inspection and ongoing validation activities).
  • Option 2: Self-declaration with requirements similar to EN 50581/IEC 63000.  

Both of these options require companies to submit data (documentation and declarations) to a database. Companies in scope of the catalog will need to determine which option they want to implement and begin the process to get the certifications immediately. The assessment requirements come into effect on November 1, 2019.
